Congratulations to Clara Steinitz for having secured a win on first instance before the Court of Paris for her client in a rare case of fortuitous encounter of copyrightable works. The case opposed a film producer and a major streaming platform of movies and series. Clara’s client was accused of having “stolen” the scenario from the film … but Clara was able to prove painstakingly that – upstream of the comparison of the works, which would also have led to a dismissal of the claims – there was no way the writers could ever have had access to the prior film. The first judge was convinced and dismissed the plaintiff. The case is currently on appeal.
