TALIENS Associate Cornelius Sauerborn has, along with Prof. Dr. Jürgen Kühling, LL.M., authored an expert opinion for the German E-Commerce and Distance Selling Trade Association (“Bundesverband E-Commerce und Versandhandel” – bevh). In their opinion, the authors address the question of whether further regulation is required for manipulative interface designs, such as highlighted consent-buttons on websites or advertisements masquerading as news articles, so-called “dark patterns”. The paper examines the existing regulations in consumer law, unfair competition law and data protection law and comments on the European legislator’s projects in the Digital Services Act.
